Welcome to Appraiser.AI ("the Tool"), owned and operated by Kawaii, Inc. ("we", "us", or "our"). These Terms and Conditions ("T&C") govern your use of Appraiser.AI and all related services.

By accessing or using Appraiser.AI, you agree to be bound by these T&C. If you disagree with any part of the terms, you may not use Appraiser.AI.

By using Appraiser.AI, you also agree to the terms outlined in our Disclaimer, which can be found at appraiser.ai/disclaimer. This Disclaimer includes important information about the limitations of our AI-powered appraisals, potential inaccuracies, and your responsibilities when using our Tool. The Disclaimer is an integral part of these Terms and Conditions, and your use of Appraiser.AI is subject to your acceptance of both these T&C and the Disclaimer.

Appraiser.AI uses artificial intelligence to provide estimated appraisals for various items. These appraisals are for informational purposes only and should not be considered as official valuations.

You are responsible for:

• Providing accurate information for appraisals
• Using Appraiser.AI in compliance with all applicable laws and regulations
• Maintaining the confidentiality of your account information
• Any decisions made based on Appraiser.AI's appraisals
• Reading and understanding the Disclaimer at appraiser.ai/disclaimer

Appraiser.AI, including its software, design, and content, is protected by copyright, trademark, and other laws. Kawaii, Inc.'s trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

We provide Appraiser.AI on an "as is" and "as available" basis. We do not guarantee the accuracy, completeness, or usefulness of any appraisals. Kawaii, Inc. will not be liable for any losses or damages arising from your use of, or reliance on, Appraiser.AI.

Kawaii, Inc. disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

When you submit an item to Appraiser.AI, you choose at creation whether the resulting appraisal is Public or Private; Public is the default. Public appraisals — including the images you submit and the generated appraisal — are publicly displayed on our platform, including our community database and search, topic and tag pages, and user profiles; may be indexed by search engines; and may appear on editorial pages of our website. Do not submit images containing personal information you do not want displayed.

Private appraisals are available with any credit purchase or an active subscription. Where you have made an appraisal Private, we agree to make best efforts not to publish it anywhere on the Appraiser.AI platform — including our community database and search, topic and tag pages, and user profiles — and we ask search engines not to index its page. Please be aware that a Private appraisal is still shareable by link: anyone you share its link with can view it, and this commitment cannot extend to links you share yourself. While we take the measures described, we cannot guarantee that a Private appraisal will never be indexed or otherwise discovered.

By using the Services, you grant to Kawaii, Inc., its successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable, no-charge, royalty-free, irrevocable copyright license to use, copy, reproduce, process, adapt, modify, publish, transmit, prepare derivative works of, publicly display, publicly perform, sublicense, and/or distribute the images and item information you submit to the Services, and the appraisals, images & videos, and any other output produced by the Services at your direction, regardless of whether an appraisal's visibility is Public or Private. For clarity, changing an appraisal's visibility from Public to Private does not revoke or limit the license granted under this section with respect to that appraisal or any content associated with it. The license granted to Kawaii, Inc. remains in effect even after termination of this Agreement by any party, for any reason.

Kawaii, Inc. reserves the right to terminate or suspend access to Appraiser.AI immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the T&C.

We reserve the right to modify or replace these T&C at any time. Your continued use of Appraiser.AI after any such changes constitutes your acceptance of the new T&C.

These T&C shall be governed and construed in accordance with the laws of the jurisdiction in which Kawaii, Inc. is based, without regard to its conflict of law provisions.
